Weather Policy

This Weather Policy explains how weather-related decisions, rain-outs, rescheduling, refunds, unsafe conditions, and customer responsibilities are handled for rentals and services provided by Backyard Starz, LLC (“Backyard Starz,” “Starz,” “we,” “us,” or “our”).

By booking a rental, submitting payment, signing a booking agreement, checking an acceptance box, accepting delivery, allowing setup, taking possession of equipment, or using our equipment or services, you agree to this Weather Policy.

1. Outdoor Movie Events Are Weather-Dependent

Backyard Starz provides outdoor movie rental equipment. Because our equipment is used outdoors, weather can affect whether an event can safely proceed.

Weather conditions that may affect your event include, but are not limited to:

  • Rain;
  • Lightning;
  • Thunderstorms;
  • High winds or wind gusts;
  • Wet or muddy ground;
  • Standing water;
  • Unsafe electrical conditions;
  • Extreme weather;
  • Conditions likely to create a safety hazard or damage equipment.

Safety and equipment protection are our top priorities.

2. We Do Not Set Up in Active Rain

Backyard Starz does not set up outdoor movie equipment in active rain.

If it is raining at the scheduled setup time, or if rain is expected to create unsafe conditions during setup or the rental period, Backyard Starz may cancel, delay, modify, or reschedule the event.

A covered backup location may be acceptable if Backyard Starz determines that the location is safe, dry, accessible, and suitable for the equipment.

3. Weather-Related Decisions

Weather decisions are made by Backyard Starz based on available information, including forecasts, radar, timing, site conditions, wind, rain, lightning risk, ground conditions, electrical safety, and equipment risk.

Backyard Starz reserves the right to cancel, delay, modify, or reschedule an event if we determine that weather conditions may be hazardous to customers, guests, Backyard Starz personnel, property, or equipment.

Weather can change quickly. A forecast alone does not automatically require cancellation, but Backyard Starz may act when conditions create a reasonable safety or equipment concern.

4. Rain-Out Decision Window

Weather-related rain-out decisions are generally made within 12 hours of the scheduled event or setup time.

If Backyard Starz determines within that window that the event cannot safely proceed because of rain or unsafe weather conditions, we may offer one of the following options:

  1. Reschedule your event for a mutually available future date; or
  2. Refund your deposit, if applicable under your booking agreement and this policy.

5. Customer-Initiated Weather Cancellations

If you are concerned about weather, please contact Backyard Starz as soon as possible.

If you cancel your event due to weather-related conditions within the applicable weather decision window, and Backyard Starz agrees that weather makes the event unsafe or unsuitable, Backyard Starz may offer to reschedule your event or refund your deposit.

If you choose to cancel because of weather concerns but Backyard Starz determines that the event can safely proceed, the standard Cancellation & Rescheduling Policy may apply.

6. No Refunds After the Weather Window Unless Approved

Weather-related refunds are generally not available after the applicable weather decision window unless Backyard Starz determines, in its discretion, that unsafe weather conditions prevent the event from proceeding.

Once Backyard Starz has delivered equipment, begun setup, completed setup, or released equipment to the customer, the rental may be considered fulfilled in whole or in part, and payments may be non-refundable.

7. Weather After Setup or During the Event

If rain, lightning, thunder, high winds, wet equipment, unsafe electrical conditions, or other unsafe weather occurs after setup or during the rental period, you must stop use immediately.

You agree to:

  1. Stop using the equipment;
  2. Keep guests and children away from equipment if conditions are unsafe;
  3. Protect equipment from rain, sprinklers, mud, water, and wind where it is safe to do so;
  4. Follow all instructions provided by Backyard Starz;
  5. Contact Backyard Starz promptly if equipment becomes wet, unstable, damaged, or unsafe.

You may be responsible for damage, injury, or loss caused by continued use during unsafe weather or failure to follow weather-related instructions.

8. Wind and Temporary Structures

Inflatable screens, inflatable seating, stands, tables, and related equipment are temporary structures and may become unsafe in high winds, wind gusts, storms, severe rain, or rapidly changing weather.

Backyard Starz may refuse setup, require takedown, or cancel/reschedule service if wind or forecasted wind conditions create an unreasonable risk.

You and your guests should move away from screens, inflatables, stands, and equipment during strong winds, thunderstorms, severe rain, or other unsafe conditions.

9. Lightning and Thunderstorms

Backyard Starz equipment should not be used during lightning or thunderstorms.

If lightning, thunder, or a thunderstorm is present or approaching, you must stop use immediately and move guests away from equipment, cords, screens, stands, and open outdoor areas.

Backyard Starz may cancel, delay, or reschedule an event if lightning or thunderstorms are present, forecasted, or likely during the rental period.

10. Wet Ground, Mud, and Standing Water

Even if it is not actively raining, Backyard Starz may refuse or modify setup if the ground is wet, muddy, saturated, unstable, or unsafe.

Standing water, mud, poor drainage, wet grass, or slippery surfaces can create safety risks and may damage equipment.

Backyard Starz may require an alternate setup location or reschedule the event if the original setup area is not suitable.

11. Sprinklers and Water Exposure

You are responsible for turning off all sprinklers before and during the event.

Backyard Starz equipment must not be exposed to sprinklers, irrigation systems, hoses, pools, water features, or other water sources.

You may be responsible for damage caused by sprinklers, water exposure, wet ground, or failure to protect equipment from water.

12. Covered or Indoor Backup Locations

A covered or indoor backup location may allow the event to proceed if outdoor conditions are unsafe.

Examples may include a garage, covered patio, pavilion, indoor room, or other protected space.

Any backup location must be:

  • Dry;
  • Safe;
  • Accessible;
  • Large enough for the equipment;
  • Suitable for electrical use;
  • Free from water exposure and trip hazards;
  • Approved by Backyard Starz.

Backyard Starz is not required to set up in a backup location that we determine is unsafe, too small, inaccessible, or unsuitable.

13. Customer Responsibility for Weather Exposure

You are responsible for protecting Backyard Starz equipment from weather exposure while the equipment is in your possession or under your control.

You may be responsible for cleaning, repair, replacement, administrative, labor, shipping, and related costs if equipment is damaged by:

  • Rain;
  • Sprinklers;
  • Standing water;
  • Mud;
  • Wet ground;
  • Wind;
  • Lightning;
  • Failure to stop use during unsafe conditions;
  • Failure to follow Backyard Starz instructions;
  • Failure to provide a safe or suitable setup location.

14. Relationship to Cancellation and Rescheduling Policy

This Weather Policy should be read together with Backyard Starz’s Cancellation & Rescheduling Policy.

Standard cancellations are handled under the Cancellation & Rescheduling Policy. Weather-related cancellations and rescheduling are handled under this Weather Policy.

If there is a conflict between this policy and a signed booking agreement, invoice, or event-specific written agreement, the event-specific written agreement will control for that event, unless prohibited by law.

15. Customer Acknowledgment

By booking a rental, submitting payment, signing a booking agreement, checking an acceptance box, accepting delivery, allowing setup, taking possession of equipment, or using Backyard Starz equipment or services, you acknowledge that you have read, understand, and agree to this Weather Policy.
