Waiver & Liability Release

IMPORTANT LEGAL NOTICE: PLEASE READ CAREFULLY. THIS WAIVER AFFECTS YOUR LEGAL RIGHTS.

This Waiver & Liability Release, Assumption of Risk, Release of Claims, and Indemnity Agreement (“Waiver”) applies to all rentals, deliveries, setup, takedown, pickup, equipment, accessories, and services provided by Backyard Starz, LLC (“Backyard Starz,” “Starz,” “we,” “us,” or “our”).

By booking a rental, submitting payment, signing a booking agreement, checking an acceptance box, accepting delivery, allowing setup, taking possession of equipment, or using Backyard Starz equipment or services, you acknowledge that you have read, understand, and agree to this Waiver.

This Waiver applies to you as the customer, event host, parent, guardian, property owner, renter, venue representative, or responsible party, as applicable (“Customer,” “you,” or “your”).

1. Customer Responsibility

You represent that you are at least 18 years old and are authorized to book the event and accept responsibility for the rental location, guests, invitees, children, participants, attendees, vendors, and any other persons present during the rental period.

You understand that Backyard Starz provides outdoor movie rental equipment and related services. Backyard Starz does not provide childcare, babysitting, lifeguarding, security, crowd control, guest supervision, or event management services.

You are responsible for supervising all guests and children at all times and for ensuring that all equipment is used safely and only as intended.

2. Equipment and Services Covered

This Waiver applies to all Backyard Starz equipment and services, including but not limited to:

  • Inflatable movie screens;
  • Projectors;
  • Speakers;
  • DVD players or media players;
  • Inflatable lounge chairs;
  • Tables;
  • Extension cords and electrical cords;
  • Stakes, stands, weights, pumps, containers, and accessories;
  • Delivery, setup, takedown, pickup, instruction, and support.

Unless expressly agreed in writing, Backyard Starz provides rental equipment only. Backyard Starz does not provide movie licenses, public performance rights, streaming accounts, DVDs, video game consoles, laptops, cable boxes, or other media.

You are solely responsible for ensuring that any movie, video, game, streaming content, or other media shown at your event is appropriate for your audience and used in compliance with applicable copyright, licensing, venue, HOA, school, municipal, or public performance rules.

3. Assumption of Risk

You understand and acknowledge that outdoor movie events and rental equipment involve inherent and other risks, whether known or unknown, obvious or hidden, foreseeable or unforeseeable.

These risks may include, but are not limited to:

  • Slips, trips, falls, and collisions;
  • Injuries involving cords, stakes, tables, chairs, screens, stands, speakers, projectors, containers, or other equipment;
  • Children or guests jumping on, falling from, climbing on, wrestling on, pulling, pushing, moving, or misusing equipment;
  • Inflatable chairs being punctured, torn, deflated, overinflated, or misused;
  • Equipment tipping, collapsing, shifting, deflating, malfunctioning, or becoming unstable;
  • Electrical shock, tripped breakers, faulty outlets, power interruptions, generator issues, overloaded circuits, cord misuse, or contact between electrical equipment and water;
  • Weather-related hazards, including rain, lightning, thunder, high winds, wind gusts, wet ground, mud, heat, humidity, cold, darkness, poor visibility, or rapidly changing outdoor conditions;
  • Property hazards, including uneven ground, holes, slopes, rocks, glass, sharp objects, fire ants, insects, pets, landscaping, sprinkler heads, irrigation systems, underground utilities, pools, decks, patios, fences, driveways, walkways, stairs, and other site conditions;
  • Food, drinks, alcohol, guest behavior, crowding, horseplay, intoxication, or failure to follow instructions;
  • Fire, smoke, grills, fire pits, candles, fireworks, heaters, combustible materials, or other open-flame hazards;
  • Damage to lawns, landscaping, irrigation systems, flooring, patios, walls, fences, furniture, vehicles, electrical systems, or other property;
  • Serious bodily injury, disability, death, emotional distress, economic loss, or property damage.

You voluntarily assume all risks arising out of or related to the rental, delivery, setup, takedown, pickup, presence, use, misuse, operation, supervision, or condition of Backyard Starz equipment or services.

4. Customer Safety Duties

You agree to follow all written and verbal instructions, safety rules, policies, and warnings provided by Backyard Starz.

You agree to ensure that:

  1. A responsible adult supervises the event and all children at all times.
  2. Guests do not climb, jump on, hang from, pull, push, move, tamper with, or misuse equipment.
  3. Inflatable chairs are used only for normal seated use and are not used as pool floats, bounce toys, beds, wrestling mats, climbing toys, or rough-play equipment.
  4. Equipment is kept away from pools, sprinklers, rain, mud, food, drinks, pets, sharp objects, fire, grills, smoking, fireworks, heaters, and combustible materials.
  5. Sprinklers are turned off before and during the event.
  6. Cooking, smoking, fire, open flames, and combustible materials are kept at least 10 feet away from inflatable screens, inflatable chairs, and related equipment.
  7. Equipment is not operated during rain, lightning, thunder, high winds, unsafe weather, or unsafe site conditions.
  8. Equipment is not moved after setup unless Backyard Starz gives permission or instructions.
  9. The setup area is clean, dry, reasonably flat, accessible, and free of hazards.
  10. Backyard Starz is contacted promptly if equipment becomes wet, damaged, unstable, unsafe, or inoperable.

5. Weather and Unsafe Conditions

You understand that Backyard Starz may refuse setup, delay setup, modify setup, stop service, cancel service, or require rescheduling if, in Backyard Starz’s reasonable judgment, weather, wind, rain, lightning, ground conditions, electrical conditions, access issues, guest conduct, or site conditions create an unsafe condition or unreasonable risk to people, property, or equipment.

You agree to stop use immediately if rain, lightning, thunder, high winds, wet equipment, electrical issues, unstable equipment, or other unsafe conditions occur.

You understand that you may be responsible for damage or injury caused by continued use during unsafe conditions or by failure to protect equipment as instructed.

6. Site, Electrical, and Access Conditions

You are responsible for providing a safe and suitable event location, including proper access, adequate space, appropriate ground surface, and safe electrical power.

Backyard Starz does not warrant that the location chosen by you is fit or proper for setup or use of the equipment.

You agree to disclose known site hazards, including but not limited to irrigation systems, sprinkler heads, underground utilities, steep slopes, sharp surfaces, low-hanging branches, pets, fire ants, wet areas, poor drainage, restricted access, non-grass surfaces, HOA rules, venue rules, and public park requirements.

For non-grass surfaces such as turf, concrete, pavement, patios, or other hard surfaces, weighted anchoring may be required. You may be responsible for providing or renting appropriate weighted items if they are not included in your rental package.

7. Damage, Loss, Theft, and Cleaning Responsibility

You are responsible for all damage to, loss of, theft of, destruction of, or excessive cleaning required for Backyard Starz equipment while it is out of Backyard Starz’s possession or otherwise under your control, except for ordinary wear and tear.

Damage may include, but is not limited to:

  • Punctures, tears, stains, mildew, wax, food or drink residue, pet damage, water exposure, sprinkler exposure, electrical damage, missing parts, broken equipment, damaged cords, damaged inflatables, damaged screens, damaged projectors, damaged speakers, or equipment returned dirty, wet, improperly packed, or incomplete.

You agree to pay all repair, replacement, cleaning, administrative, labor, shipping, and related costs associated with damaged, lost, stolen, missing, or excessively dirty equipment, as provided in the Rental Agreement and applicable Backyard Starz policies.

8. Release of Liability — Including Ordinary Negligence

TO THE MAXIMUM EXTENT PERMITTED BY TEXAS LAW, YOU, ON BEHALF OF YOURSELF, YOUR CHILDREN, MINOR PARTICIPANTS FOR WHOM YOU ARE RESPONSIBLE, YOUR GUESTS, INVITEES, ATTENDEES, FAMILY MEMBERS, HEIRS, PERSONAL REPRESENTATIVES, SUCCESSORS, AND ASSIGNS, HEREBY RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE BACKYARD STARZ, LLC, INCLUDING ITS OWNERS, MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, REPRESENTATIVES, AGENTS, AFFILIATES, SUCCESSORS, AND ASSIGNS, FROM ANY AND ALL CLAIMS, DEMANDS, DAMAGES, LOSSES, LIABILITIES, COSTS, EXPENSES, ATTORNEY’S FEES, CAUSES OF ACTION, OR SUITS OF ANY KIND ARISING OUT OF OR RELATED TO THE RENTAL, DELIVERY, SETUP, TAKEDOWN, PICKUP, PRESENCE, USE, MISUSE, OPERATION, CONDITION, SUPERVISION, OR FAILURE OF BACKYARD STARZ EQUIPMENT OR SERVICES, INCLUDING CLAIMS ARISING FROM OR CAUSED IN WHOLE OR IN PART BY THE ORDINARY NEGLIGENCE OF BACKYARD STARZ, LLC OR ANY OTHER RELEASED PARTY.

THIS RELEASE INCLUDES, WITHOUT LIMITATION, CLAIMS FOR PERSONAL INJURY, BODILY INJURY, DEATH, PROPERTY DAMAGE, ECONOMIC LOSS, LOSS OF USE, EVENT INTERRUPTION, LOSS OF ENJOYMENT, AND ANY OTHER LOSS, DAMAGE, OR INJURY, WHETHER OCCURRING BEFORE, DURING, OR AFTER THE EVENT, TO THE EXTENT PERMITTED BY LAW.

This release does not apply to claims that cannot legally be released under applicable law.

9. Indemnification and Defense

TO THE MAXIMUM EXTENT PERMITTED BY TEXAS LAW, YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS BACKYARD STARZ, LLC, INCLUDING ITS OWNERS, MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, REPRESENTATIVES, AGENTS, AFFILIATES, SUCCESSORS, AND ASSIGNS, FROM AND AGAINST ANY AND ALL CLAIMS, DEMANDS, DAMAGES, LOSSES, LIABILITIES, COSTS, EXPENSES, ATTORNEY’S FEES, CAUSES OF ACTION, OR SUITS ARISING OUT OF OR RELATED TO:

  1. The event, rental, delivery, setup, takedown, pickup, presence, use, misuse, operation, condition, or supervision of Backyard Starz equipment or services;
  2. Any injury to or death of any person, including you, your children, guests, invitees, attendees, family members, vendors, neighbors, or third parties;
  3. Any damage to or destruction of property, including property owned by you, Backyard Starz, guests, invitees, venues, property owners, neighbors, or third parties;
  4. Any act, omission, negligence, recklessness, misconduct, or failure to supervise by you, your children, guests, invitees, attendees, family members, vendors, or anyone present at the event location;
  5. Any breach of this Waiver, the Rental Agreement, or any Backyard Starz policy, safety rule, instruction, or warning;
  6. Any unsafe site condition, inadequate electrical condition, weather exposure, access issue, permit issue, HOA or venue rule violation, noise complaint, alcohol-related incident, guest conduct issue, or public performance/movie licensing issue; and
  7. Any damage, loss, theft, cleaning issue, or replacement cost involving Backyard Starz equipment.

This indemnity obligation applies regardless of whether the claim is brought by you, a minor, a guest, an invitee, a parent or guardian, a property owner, a venue, a neighbor, a governmental authority, or any other third party, to the extent permitted by law.

10. Minor Participants

If children or minors will be present, you are responsible for supervising them at all times.

To the extent permitted by law, you agree to this Waiver on behalf of your minor children and any minor participants for whom you are the parent, legal guardian, host, or responsible adult.

You also agree to defend and indemnify Backyard Starz from claims brought by or on behalf of any minor arising out of or related to the event, rental, equipment, services, or your failure to supervise.

11. Medical Care

In the event of an emergency, Backyard Starz personnel, if present, may contact emergency services.

Backyard Starz is not responsible for providing medical care, first aid, supervision, or emergency response.

You are responsible for all medical expenses incurred by you, your children, guests, invitees, attendees, or any other person present at the event.

12. No Warranty; Limitation of Liability

Backyard Starz provides rental equipment and services as described in the applicable booking confirmation, package description, Rental Agreement, and related policies.

To the maximum extent permitted by law, Backyard Starz disclaims all warranties, express or implied, including any implied warranty of merchantability or fitness for a particular purpose.

To the maximum extent permitted by law, Backyard Starz’s total liability for any claim arising out of or related to the rental, equipment, or services shall not exceed the amount paid by Customer for the specific rental giving rise to the claim.

13. Governing Law and Severability

This Waiver shall be governed by the laws of the State of Texas.

If any provision of this Waiver is found invalid, unenforceable, or overly broad, the remaining provisions shall remain in full force and effect to the maximum extent permitted by law.

14. Customer Acknowledgment

By booking a rental, submitting payment, signing a booking agreement, checking an acceptance box, accepting delivery, allowing setup, taking possession of equipment, or using Backyard Starz equipment or services, you acknowledge that:

  1. You have read this Waiver;
  2. You understand its terms;
  3. You understand that outdoor movie rentals and related equipment involve risks;
  4. You accept responsibility for supervising your event and guests;
  5. You agree to release and indemnify Backyard Starz as stated above; and
  6. You understand that you are giving up substantial legal rights, including the right to sue Backyard Starz for certain claims, including claims arising from Backyard Starz’s ordinary negligence, to the extent permitted by law.
