Movie, Media & Copyright Policy

This Movie, Media & Copyright Policy explains customer responsibility for movies, streaming services, media devices, internet access, public performance rights, copyright compliance, and related issues for rentals and services provided by Backyard Starz, LLC (“Backyard Starz,” “Starz,” “we,” “us,” or “our”).

By booking a rental, submitting payment, signing a booking agreement, checking an acceptance box, accepting delivery, allowing setup, taking possession of equipment, or using our equipment or services, you agree to this Movie, Media & Copyright Policy.

1. Backyard Starz Provides Equipment, Not Content

Unless expressly agreed in writing, Backyard Starz provides outdoor movie rental equipment only.

Depending on your selected package, this may include items such as:

  • Inflatable movie screen;
  • Projector;
  • Speaker or speakers;
  • DVD player or media player;
  • Inflatable lounge chairs;
  • Tables;
  • Extension cords;
  • Air pumps, stands, stakes, weights, containers, and accessories.

Backyard Starz does not provide the movie, video, show, streaming account, DVD, video game, laptop, cable box, internet service, public performance license, copyright license, venue permit, HOA approval, or other media rights unless expressly agreed in writing.

2. Customer Responsibility for Movie or Media Selection

Customer is solely responsible for selecting, providing, and controlling any movie, video, streaming content, game, slideshow, music, or other media shown, played, streamed, projected, or displayed during the event.

Customer is responsible for ensuring that the selected content is:

  1. Appropriate for the audience;
  2. Suitable for children or minors attending the event, if applicable;
  3. Available and ready before the event begins;
  4. Compatible with the equipment being used;
  5. Used in compliance with applicable laws, licenses, platform terms, venue rules, HOA rules, school rules, park rules, and other requirements.

Backyard Starz does not review, approve, rate, monitor, or control the content shown at Customer’s event.

3. Copyright and Public Performance Responsibility

Customer is solely responsible for determining whether the event requires a public performance license, copyright license, permission, permit, or other authorization.

Customer is solely responsible for obtaining any required rights or licenses before showing, streaming, projecting, or displaying any copyrighted content.

Backyard Starz does not provide legal advice regarding copyright law, movie licensing, streaming terms, public performance rights, or whether a particular event requires a license.

Backyard Starz is not responsible for any unauthorized public performance, copyright infringement, licensing violation, streaming-platform violation, venue violation, HOA violation, school violation, park violation, or other improper use of copyrighted material by Customer or any third party.

4. Private Events vs. Public Events

Some backyard movie nights may be private events, while other events may be public, semi-public, commercial, ticketed, advertised, school-based, HOA-based, venue-based, park-based, church-based, apartment-community-based, or otherwise outside ordinary private home viewing.

Customer is responsible for determining the nature of the event and whether any license, approval, or authorization is required.

Events that may require additional review include, but are not limited to:

  • Public park events;
  • School events;
  • Church events;
  • HOA or neighborhood events;
  • Apartment community events;
  • Commercial venue events;
  • Business events;
  • Fundraisers;
  • Ticketed events;
  • Events advertised to the public;
  • Events hosted by organizations, clubs, nonprofits, or municipalities;
  • Events where admission, donations, sponsorship, or commercial benefit is involved.

Customer should consult an attorney, licensing provider, venue, or other appropriate advisor if unsure whether a license is required.

5. Streaming Services and Platform Terms

Customer is responsible for complying with the terms and conditions of any streaming service, app, platform, or digital account used during the event.

Backyard Starz is not responsible for whether a streaming service permits outdoor viewing, group viewing, public viewing, commercial use, screen mirroring, projection, or playback at the event.

Customer is responsible for:

  • Active subscriptions;
  • Login credentials;
  • Passwords;
  • Account access;
  • Device authorization;
  • App restrictions;
  • Location restrictions;
  • Rental windows;
  • Playback limits;
  • Platform outages;
  • Updates;
  • Content availability;
  • Internet access;
  • Any restrictions imposed by the streaming platform.

6. Customer-Provided Devices

Unless otherwise agreed in writing, Customer is responsible for providing and operating any customer-owned media device, including but not limited to:

  • Laptop;
  • Streaming stick;
  • Tablet;
  • Phone;
  • Gaming console;
  • Cable box;
  • Blu-ray player;
  • DVD;
  • Hotspot;
  • Router;
  • Adapter;
  • HDMI cable or specialty cable;
  • Remote;
  • Charger;
  • Power supply.

Customer should test all customer-provided devices, accounts, passwords, apps, cables, adapters, and content before the event.

Backyard Starz is not responsible for customer-provided devices that are dead, locked, incompatible, missing adapters, missing cables, unavailable, not logged in, unable to stream, unable to connect, or not working properly.

7. Internet and Wi-Fi

Unless expressly agreed in writing, Backyard Starz does not provide internet service, Wi-Fi, cellular data, hotspots, routers, or streaming connectivity.

Customer is responsible for ensuring that internet or Wi-Fi is available, strong enough, and reliable enough for streaming or online playback.

Backyard Starz is not responsible for:

  • Weak Wi-Fi signal;
  • Slow internet;
  • Buffering;
  • App freezes;
  • Streaming interruptions;
  • Internet outages;
  • Cellular coverage issues;
  • Router problems;
  • Hotspot problems;
  • Login problems;
  • Platform outages;
  • Content not loading;
  • Streaming quality issues.

For the most reliable experience, Backyard Starz recommends using a DVD, downloaded content that is lawfully available for the intended use, or another directly compatible media source when possible.

8. Compatibility

Customer is responsible for ensuring that customer-provided media, devices, and accessories are compatible with the equipment being used.

Backyard Starz may provide general guidance, but does not guarantee compatibility with every device, app, streaming platform, game console, laptop, phone, tablet, adapter, cable, or content source.

Customer should confirm compatibility before the event and have a backup plan available.

9. Technical Support

Backyard Starz may provide reasonable setup or troubleshooting assistance for connecting media equipment, subject to availability and the package selected.

However, Backyard Starz is not responsible for technical issues caused by:

  • Customer-provided devices;
  • Streaming services;
  • Internet or Wi-Fi;
  • Login credentials;
  • Account restrictions;
  • Missing adapters;
  • Incompatible devices;
  • Damaged customer equipment;
  • Software updates;
  • App outages;
  • Content availability;
  • Customer-selected media.

Technical issues caused by customer-provided media, devices, accounts, or internet service do not entitle Customer to a refund unless Backyard Starz agrees otherwise in writing.

10. Backup Media Recommended

Customer should have a backup media plan available in case the preferred content source does not work.

Recommended backups may include:

  • A DVD or Blu-ray, if compatible with the package;
  • A second streaming device;
  • Downloaded content that is lawfully available for the intended use;
  • A backup laptop or tablet;
  • A backup HDMI cable or adapter;
  • A second movie option;
  • A reliable internet hotspot, if streaming is required.

Backyard Starz is not responsible if Customer does not have a working backup option.

11. No Unlawful or Inappropriate Content

Customer may not use Backyard Starz equipment to display or play content that is unlawful, obscene, harassing, threatening, defamatory, exploitative, discriminatory, abusive, or otherwise inappropriate for the event setting.

Backyard Starz reserves the right to refuse service, stop service, or require takedown if we reasonably believe the equipment is being used for unlawful, unsafe, threatening, or inappropriate content or activity.

12. Music, Games, Sports, and Other Content

This policy applies not only to movies, but also to any other content shown, played, streamed, projected, or displayed using Backyard Starz equipment, including:

  • TV shows;
  • Sports broadcasts;
  • Video games;
  • Music videos;
  • Concerts;
  • Slideshows;
  • Presentations;
  • YouTube videos;
  • Streaming content;
  • Live broadcasts;
  • User-generated content;
  • Commercial, branded, or sponsored content.

Customer is responsible for any licenses, permissions, subscriptions, or approvals required for such content.

13. Indemnification for Media and Copyright Claims

To the maximum extent permitted by law, Customer agrees to indemnify, defend, and hold harmless Backyard Starz, LLC, including its owners, members, managers, employees, contractors, representatives, agents, affiliates, successors, and assigns, from and against any claims, demands, damages, losses, liabilities, costs, expenses, attorney’s fees, or legal actions arising out of or related to:

  1. Customer’s selection, provision, use, streaming, display, projection, or performance of any movie, video, game, music, broadcast, presentation, or other content;
  2. Any alleged copyright infringement, public performance violation, streaming-platform violation, licensing violation, or terms-of-service violation;
  3. Any failure by Customer to obtain required licenses, permits, permissions, or approvals;
  4. Any claim by a copyright owner, studio, distributor, platform, venue, HOA, school, park, municipality, organization, attendee, or third party related to the content shown at the event;
  5. Any inappropriate, unlawful, or unauthorized content displayed using Backyard Starz equipment.

14. Relationship to Other Policies

This Movie, Media & Copyright Policy should be read together with Backyard Starz’s:

  • Rental Agreement / Terms of Service;
  • Waiver & Liability Release;
  • Setup, Delivery & Pickup Policy;
  • DIY Drop-Off / Self-Setup Policy;
  • Electrical, Power & Generator Policy;
  • Equipment Safety Rules;
  • Alcohol & Guest Conduct Policy.

If there is a conflict between this policy and a signed booking agreement, invoice, or event-specific written agreement, the event-specific written agreement will control for that event, unless prohibited by law.

15. Customer Acknowledgment

By booking a rental, submitting payment, signing a booking agreement, checking an acceptance box, accepting delivery, allowing setup, taking possession of equipment, or using Backyard Starz equipment or services, you acknowledge that you have read, understand, and agree to this Movie, Media & Copyright Policy.
