Alcohol & Guest Conduct Policy

This Alcohol & Guest Conduct Policy explains customer responsibility for alcohol, guest behavior, supervision, safety, illegal substances, property rules, and conduct during rentals and services provided by Backyard Starz, LLC (“Backyard Starz,” “Starz,” “we,” “us,” or “our”).

By booking a rental, submitting payment, signing a booking agreement, checking an acceptance box, accepting delivery, allowing setup, taking possession of equipment, or using our equipment or services, you agree to this Alcohol & Guest Conduct Policy.

1. Customer Responsibility for Guests

Customer is responsible for the conduct, supervision, and safety of all guests, children, invitees, attendees, vendors, family members, neighbors, and any other persons present during the rental period.

Backyard Starz provides outdoor movie rental equipment and related services. Backyard Starz does not provide security, crowd control, childcare, babysitting, lifeguarding, alcohol monitoring, guest supervision, or event management services.

Customer is responsible for ensuring that all guests use Backyard Starz equipment safely and follow all applicable Backyard Starz policies, safety rules, and instructions.

2. Alcohol Is Customer’s Responsibility

Backyard Starz does not provide, sell, serve, distribute, supervise, monitor, or manage alcohol at customer events.

If alcohol is present at an event, Customer is solely responsible for ensuring that alcohol is provided, possessed, consumed, and managed lawfully and safely.

Customer is responsible for complying with all applicable laws, venue rules, HOA rules, park rules, apartment community rules, school rules, church rules, lease restrictions, and private property requirements related to alcohol.

3. No Underage Drinking

Customer is responsible for preventing underage drinking at the event.

Backyard Starz is not responsible for checking IDs, monitoring alcohol consumption, policing guests, or enforcing alcohol laws on Customer’s behalf.

If minors are present, Customer must ensure that alcohol is kept secure and that minors are supervised appropriately.

4. Intoxicated or Unsafe Guests

Customer is responsible for ensuring that intoxicated, impaired, reckless, aggressive, or unsafe guests do not use or interfere with Backyard Starz equipment.

Guests may not use, move, touch, climb on, tamper with, or operate equipment if they are intoxicated, impaired, reckless, aggressive, or unable to use the equipment safely.

Customer is responsible for any injury, damage, loss, cleaning, missing items, or unsafe condition caused by intoxicated or impaired guests.

5. Prohibited Guest Conduct

Customer and guests may not engage in conduct that is unsafe, unlawful, disruptive, threatening, aggressive, destructive, or likely to damage equipment or property.

Prohibited conduct includes, but is not limited to:

  1. Climbing on, jumping on, hanging from, pulling, pushing, moving, or tampering with equipment;
  2. Roughhousing, wrestling, fighting, running into equipment, or horseplay near the screen, chairs, projector, speakers, cords, stakes, tables, or other equipment;
  3. Throwing objects at or near equipment;
  4. Damaging, staining, puncturing, tearing, burning, wetting, or misusing equipment;
  5. Harassing, threatening, or interfering with Backyard Starz personnel;
  6. Refusing to follow safety instructions;
  7. Using equipment during unsafe weather or unsafe conditions;
  8. Bringing open flames, fireworks, smoking materials, grills, heaters, or combustible materials near equipment;
  9. Creating excessive noise, neighbor complaints, or public disturbances;
  10. Engaging in illegal activity.

6. Illegal Drugs and Controlled Substances

Customer is responsible for ensuring that the event complies with all applicable laws regarding illegal drugs, controlled substances, and impaired conduct.

Backyard Starz may refuse service, stop service, or leave the event location if illegal drug use, unsafe substance use, or impaired guest conduct creates a safety, legal, operational, or equipment risk.

7. Smoking, Vaping, Fire, and Open Flame

Smoking, vaping, fire, grills, fire pits, candles, fireworks, heaters, open flames, and combustible materials must be kept at least 10 feet away from inflatable screens, inflatable chairs, and related equipment.

Customer is responsible for any damage, burns, stains, odors, smoke exposure, fire damage, injury, or loss caused by smoking, vaping, fire, heat, fireworks, grills, cooking, candles, or open flames.

8. Guest Use of Equipment

Customer is responsible for making sure guests use all Backyard Starz equipment only as intended.

Guests may not:

  • Jump on inflatable chairs;
  • Stand on inflatable chairs;
  • Use inflatable chairs as pool floats, bounce toys, beds, wrestling mats, slides, or climbing toys;
  • Climb on or pull the movie screen;
  • Move speakers, projectors, cords, stands, tables, screens, or other equipment after setup;
  • Unplug, reconnect, restart, modify, or tamper with electrical equipment;
  • Place food, drinks, alcohol, candles, decorations, or personal items on or near equipment;
  • Use equipment in unsafe weather or unsafe conditions.

Adult supervision is required at all times.

9. Property Damage and Cleaning

Customer is responsible for damage, loss, theft, missing items, and excessive cleaning caused by Customer, guests, children, invitees, attendees, pets, vendors, or anyone present at the event.

This includes damage or cleaning related to:

  • Alcohol spills;
  • Food or drink stains;
  • Vomit;
  • Smoke or odor;
  • Broken equipment;
  • Punctures or tears;
  • Missing items;
  • Pet damage;
  • Fire or burn damage;
  • Water or sprinkler exposure;
  • Guest misuse;
  • Roughhousing or unsafe behavior.

Backyard Starz may charge Customer for cleaning, repair, replacement, labor, administrative fees, shipping, and related costs as described in the Damage, Cleaning & Missing Equipment Policy.

10. Parks, Venues, HOAs, and Shared Spaces

If the event takes place at a park, venue, HOA common area, apartment community, school, church, business, or shared space, Customer is responsible for confirming whether alcohol is allowed.

Customer is responsible for obtaining any required permissions, permits, approvals, security, insurance, or licenses related to alcohol or event conduct.

Backyard Starz is not responsible for denied access, event shutdowns, fines, citations, penalties, venue enforcement, HOA enforcement, park enforcement, police involvement, or other consequences related to alcohol or guest conduct.

11. Right to Refuse, Stop, or End Service

Backyard Starz reserves the right to refuse setup, stop setup, reduce service, begin takedown, leave the event location, or end service if we determine that alcohol use, guest conduct, unsafe behavior, illegal activity, threats, aggression, or property conditions create an unreasonable risk to people, property, equipment, or Backyard Starz personnel.

This may include, but is not limited to:

  1. Intoxicated or impaired guests interfering with equipment;
  2. Guests refusing to follow safety instructions;
  3. Aggressive, threatening, or harassing behavior;
  4. Fighting, disorderly conduct, or unsafe crowd behavior;
  5. Illegal drug use or unlawful activity;
  6. Unsafe use of fire, fireworks, grills, heaters, or smoking materials;
  7. Excessive noise or neighbor complaints;
  8. Police, security, HOA, venue, property owner, or code enforcement involvement;
  9. Any situation where Backyard Starz personnel reasonably feel unsafe.

Payments may be non-refundable if service is interrupted, stopped, shortened, or ended because of Customer or guest conduct.

12. No Duty to Intervene

Backyard Starz may choose to notify Customer of unsafe behavior or equipment misuse, but Backyard Starz has no duty to supervise guests, monitor alcohol consumption, intervene in disputes, remove guests, enforce house rules, or provide security.

Customer remains responsible for the event and all guest conduct.

13. Customer Responsibility for Transportation and Safety

Customer is responsible for managing guest safety, including transportation, intoxicated guests, and safe departure from the event.

Backyard Starz is not responsible for guest transportation, rideshare coordination, impaired driving, guest injuries, or incidents occurring before, during, or after the event.

14. Indemnification for Alcohol and Guest Conduct Issues

To the maximum extent permitted by law, Customer agrees to indemnify, defend, and hold harmless Backyard Starz, LLC, including its owners, members, managers, employees, contractors, representatives, agents, affiliates, successors, and assigns, from and against any claims, demands, damages, losses, liabilities, costs, expenses, attorney’s fees, fines, citations, penalties, or legal actions arising out of or related to:

  1. Alcohol provided, possessed, served, consumed, or allowed at the event;
  2. Underage drinking;
  3. Intoxicated or impaired guests;
  4. Illegal drug use or unlawful activity;
  5. Guest conduct, misconduct, negligence, recklessness, aggression, or unsafe behavior;
  6. Injury to or death of any person;
  7. Damage to property or Backyard Starz equipment;
  8. Noise complaints, neighbor complaints, police involvement, security involvement, venue enforcement, HOA enforcement, or code enforcement;
  9. Customer’s failure to supervise guests or comply with applicable laws, rules, permits, or restrictions.

15. Relationship to Other Policies

This Alcohol & Guest Conduct Policy should be read together with Backyard Starz’s:

  • Rental Agreement / Terms of Service;
  • Waiver & Liability Release;
  • Equipment Safety Rules;
  • Damage, Cleaning & Missing Equipment Policy;
  • Noise, Time Restriction & Neighbor Policy;
  • Setup, Delivery & Pickup Policy;
  • Weather Policy;
  • Movie, Media & Copyright Policy.

If there is a conflict between this policy and a signed booking agreement, invoice, or event-specific written agreement, the event-specific written agreement will control for that event, unless prohibited by law.

16. Customer Acknowledgment

By booking a rental, submitting payment, signing a booking agreement, checking an acceptance box, accepting delivery, allowing setup, taking possession of equipment, or using Backyard Starz equipment or services, you acknowledge that you have read, understand, and agree to this Alcohol & Guest Conduct Policy.
