Noise, Time Restriction & Neighbor Policy

This Noise, Time Restriction & Neighbor Policy explains customer responsibility for sound levels, event timing, neighbor concerns, HOA rules, venue restrictions, local ordinances, and related issues for rentals and services provided by Backyard Starz, LLC (“Backyard Starz,” “Starz,” “we,” “us,” or “our”).

By booking a rental, submitting payment, signing a booking agreement, checking an acceptance box, accepting delivery, allowing setup, taking possession of equipment, or using our equipment or services, you agree to this Noise, Time Restriction & Neighbor Policy.

1. Customer Responsibility for Noise and Event Conduct

Customer is responsible for managing the event, guests, sound levels, music, movie volume, crowd noise, and general conduct during the rental period.

Backyard Starz provides outdoor movie rental equipment and related services. Backyard Starz does not provide security, crowd control, neighbor relations, HOA coordination, venue management, or event supervision.

Customer is responsible for ensuring that the event does not create unreasonable noise, disturbance, nuisance, safety issues, or complaints.

2. Local Rules, HOA Rules, and Venue Restrictions

Customer is solely responsible for understanding and complying with all rules that apply to the event location, including but not limited to:

  • City or county noise ordinances;
  • Neighborhood rules;
  • HOA restrictions;
  • Apartment community rules;
  • Park rules;
  • Venue rules;
  • School or church policies;
  • Private property restrictions;
  • Lease or rental agreement restrictions;
  • Quiet hours;
  • Curfews;
  • Permits or approvals.

Backyard Starz is not responsible for determining whether your event complies with local laws, HOA rules, venue requirements, or neighborhood restrictions.

3. Quiet Hours and Time Restrictions

Outdoor movie events often take place after dark, which may overlap with local quiet hours, HOA limits, park closing times, venue restrictions, or neighbor expectations.

Customer is responsible for confirming whether the event must end by a specific time.

If the event location has a required end time, quiet hour, curfew, or sound restriction, Customer must notify Backyard Starz before the event.

Backyard Starz may adjust setup, pickup, rental duration, or equipment use if timing restrictions are disclosed in advance and agreed in writing.

4. Rental Period Does Not Override Local Restrictions

Your Backyard Starz rental period does not override local laws, HOA rules, venue policies, park hours, or quiet-hour restrictions.

Even if your package includes a certain rental duration, Customer remains responsible for ending or reducing sound when required by applicable rules or restrictions.

If Customer chooses to extend the event beyond the agreed rental period, overtime fees may apply, but overtime approval does not mean the event is permitted under local, HOA, venue, or neighborhood rules.

5. Movie Volume and Speaker Use

Customer is responsible for keeping movie volume, music, announcements, and speaker use at a reasonable level.

Sound should be loud enough for invited guests to enjoy the event, but not so loud that it creates a disturbance for neighbors, surrounding homes, nearby businesses, shared walls, apartments, or public spaces.

Customer agrees to reduce volume promptly if requested by:

  • Backyard Starz personnel;
  • Property owners;
  • Venue staff;
  • HOA representatives;
  • Apartment management;
  • Security personnel;
  • Police or code enforcement;
  • Neighbors;
  • Other authorized persons.

6. Speaker Placement

Backyard Starz may recommend or use speaker placement intended to improve guest experience and reduce unnecessary sound travel.

Customer should not move speakers, redirect speakers toward neighboring homes, increase sound levels excessively, or add additional speakers without Backyard Starz’s permission.

Customer is responsible for any complaints, violations, or issues caused by speaker movement, excessive volume, additional audio equipment, or misuse of Backyard Starz equipment.

7. Customer-Provided Audio Equipment

Customer may not connect additional speakers, amplifiers, sound systems, microphones, DJs, karaoke equipment, or other audio equipment to Backyard Starz equipment unless Backyard Starz agrees in writing.

Customer is responsible for any noise, damage, technical issues, complaints, or violations caused by customer-provided audio equipment.

Backyard Starz may refuse to connect or support customer-provided audio equipment if it appears unsafe, incompatible, excessive, or likely to cause equipment damage or noise issues.

8. Neighbor Complaints

Customer is responsible for responding to neighbor concerns, complaints, or requests related to the event.

If a neighbor or nearby resident complains about sound, crowd noise, parking, lighting, or event activity, Customer should address the concern promptly and respectfully.

Backyard Starz may reduce volume, stop service, begin takedown, or require the event to end if noise complaints create a safety, legal, operational, or equipment concern.

9. Police, Security, HOA, Venue, or Code Enforcement Issues

If police, security, code enforcement, HOA representatives, venue staff, apartment management, park officials, or other authorities require the event to stop, reduce sound, relocate, or end early, Customer is responsible for complying.

Backyard Starz is not responsible for refunds, credits, event interruption, fines, citations, penalties, shutdowns, or lost event time caused by noise complaints, rule violations, lack of permits, HOA restrictions, venue restrictions, or law enforcement action.

Customer is responsible for any fines, penalties, fees, citations, claims, or costs arising from noise, timing, curfew, permit, parking, HOA, venue, or neighborhood issues.

10. Public Parks, Shared Spaces, and Venues

Events held in public parks, apartment courtyards, HOA common areas, schools, churches, commercial venues, or shared spaces may have special restrictions.

Customer is responsible for obtaining any required approvals, permits, reservations, or permissions before the event.

Customer must confirm any applicable rules about:

  • Event end time;
  • Sound limits;
  • Amplified audio;
  • Speaker use;
  • Generator use;
  • Parking;
  • Lighting;
  • Access;
  • Public performance;
  • Cleanup;
  • Security;
  • Park or venue closing times.

If Backyard Starz cannot complete setup or continue service because required permission was not obtained, the booking may be treated as a customer cancellation, and payments may be non-refundable.

11. Event End Time and Pickup

Customer is responsible for making sure the event ends in time to comply with all applicable noise rules, quiet hours, venue restrictions, and rental period limits.

Customer must make equipment accessible for takedown or pickup at the scheduled time.

If the event runs late, pickup is delayed, equipment is inaccessible, or Backyard Starz personnel are required to wait, additional fees may apply.

Unless otherwise stated in writing, extended rental time may be charged at $75 per additional hour, subject to Backyard Starz availability.

12. Right to Reduce Volume, Stop Service, or End Event Support

Backyard Starz reserves the right to reduce volume, disconnect audio equipment, stop service, begin takedown, or end event support if we determine that:

  1. Sound levels are excessive;
  2. Noise complaints have been received;
  3. Authorities, venue staff, HOA representatives, security, or property owners require it;
  4. The event is violating quiet hours, curfews, or venue rules;
  5. Customer or guests refuse to reduce volume or follow instructions;
  6. Continued service creates a safety, legal, operational, neighbor, or equipment risk.

Payments may be non-refundable if service is interrupted or ended due to Customer’s failure to comply with this policy.

13. No Guarantee Against Complaints

Backyard Starz may provide general suggestions for volume and speaker placement, but we cannot guarantee that neighbors, HOAs, venues, apartment communities, or authorities will not complain or object.

Customer remains responsible for the event and for complying with all applicable rules.

14. Indemnification for Noise and Time Restriction Issues

To the maximum extent permitted by law, Customer agrees to indemnify, defend, and hold harmless Backyard Starz, LLC, including its owners, members, managers, employees, contractors, representatives, agents, affiliates, successors, and assigns, from and against any claims, demands, damages, losses, liabilities, costs, expenses, attorney’s fees, fines, citations, penalties, or legal actions arising out of or related to:

  1. Noise complaints;
  2. Excessive volume;
  3. Guest or crowd noise;
  4. Event timing or curfew violations;
  5. HOA, apartment, venue, park, school, church, municipal, or neighborhood rule violations;
  6. Police, security, code enforcement, or property owner involvement;
  7. Failure to obtain required permits, permissions, or approvals;
  8. Event shutdowns, interruptions, fines, citations, or penalties.

15. Relationship to Other Policies

This Noise, Time Restriction & Neighbor Policy should be read together with Backyard Starz’s:

  • Rental Agreement / Terms of Service;
  • Setup, Delivery & Pickup Policy;
  • Payment Policy;
  • Cancellation & Rescheduling Policy;
  • Weather Policy;
  • Equipment Safety Rules;
  • Alcohol & Guest Conduct Policy;
  • Movie, Media & Copyright Policy;
  • Waiver & Liability Release.

If there is a conflict between this policy and a signed booking agreement, invoice, or event-specific written agreement, the event-specific written agreement will control for that event, unless prohibited by law.

16. Customer Acknowledgment

By booking a rental, submitting payment, signing a booking agreement, checking an acceptance box, accepting delivery, allowing setup, taking possession of equipment, or using Backyard Starz equipment or services, you acknowledge that you have read, understand, and agree to this Noise, Time Restriction & Neighbor Policy.
