These Rental Terms of Service (“Terms”) govern all rentals, bookings, deliveries, setup services, takedown services, equipment use, and related services provided by Backyard Starz, LLC (“Backyard Starz,” “Starz,” “we,” “us,” or “our”).

By booking a rental, submitting payment, signing a booking agreement, checking an acceptance box, accepting delivery, allowing setup, taking possession of equipment, or using our equipment or services, you agree to these Terms and all related Backyard Starz policies.

These Terms apply to you as the customer, event host, parent, guardian, property owner, renter, venue representative, or responsible party, as applicable (“Customer,” “you,” or “your”).

1. Services Provided

Backyard Starz provides outdoor movie rental equipment and related services for private events, parties, gatherings, and similar uses.

Depending on the package selected, your rental may include some or all of the following:

  • Inflatable movie screen;
  • Projector;
  • Speaker or speakers;
  • DVD player or media player;
  • Inflatable lounge chairs;
  • Tables;
  • Extension cords and related electrical cords;
  • Air pumps, stands, stakes, weights, containers, and accessories;
  • Delivery, setup, takedown, pickup, or DIY/drop-off service.

The specific equipment included in your rental is determined by the package, add-ons, booking confirmation, invoice, or written agreement associated with your event.

2. Customer Responsibility

You are responsible for:

  1. Providing accurate booking information, including event date, event address, contact information, setup location, and access instructions.
  2. Ensuring that the event location is safe, accessible, and suitable for outdoor movie equipment.
  3. Obtaining any required permission from a property owner, HOA, apartment community, park, venue, school, church, municipality, or other authority.
  4. Supervising all guests, children, invitees, vendors, and attendees during the rental period.
  5. Using the equipment only as intended and in accordance with all Backyard Starz instructions and policies.
  6. Protecting the equipment from damage, theft, misuse, weather, sprinklers, water, food, drinks, pets, sharp objects, fire, smoke, rough play, and unsafe conditions.
  7. Returning or making available all rental equipment in substantially the same condition as received, ordinary wear and tear excepted.

Backyard Starz does not provide childcare, babysitting, lifeguarding, security, crowd control, guest supervision, or event management services.

3. Booking and Reservation

A reservation is not confirmed until Backyard Starz receives the required deposit, payment, signed agreement, or written booking confirmation.

We cannot guarantee availability for your requested date until the required booking steps have been completed.

Backyard Starz reserves the right to decline, cancel, or modify a booking if we determine that the event location, weather, access, electrical conditions, customer conduct, or other circumstances create an unreasonable safety, legal, operational, or equipment risk.

4. Payment

Unless otherwise stated in your booking confirmation or invoice, a deposit is required to secure your event date.

For most packages, a 20% deposit is required at the time of booking. For the Family / Drop-Off Package, a 50% deposit may be required at the time of booking.

The remaining balance is due on the day of your event upon completion of setup, unless otherwise agreed in writing.

Backyard Starz currently accepts payment methods listed at booking, which may include Venmo, PayPal, or other approved payment methods.

Late payments may incur a $50 late fee for each day beyond the first 48 hours following the event.

You agree to pay all amounts owed for the rental, including package fees, add-ons, delivery fees, setup fees, takedown fees, cleaning fees, damage fees, replacement costs, late fees, collection costs, and any other charges described in these Terms, your booking confirmation, invoice, or applicable Backyard Starz policies.

5. Delivery Fees and Service Area

Delivery may be included within a specified service area or radius, as stated in your booking confirmation.

Delivery outside Backyard Starz’s standard service area may be subject to additional mileage-based or location-based fees.

Delivery fees, service availability, and setup availability may vary based on distance, package, event date, access requirements, and scheduling.

6. Rental Period and Event Timing

For events that include setup and takedown service, the rental period generally begins at sunset and lasts for the rental duration stated in your package or booking confirmation.

Unless otherwise stated in writing, Backyard Starz may begin setup approximately two hours before sunset.

Movie screenings are recommended after dark for the best viewing experience. Backyard Starz cannot guarantee satisfactory image quality if a movie or video is started before dusk or in bright lighting conditions.

If your event extends beyond the designated rental period, additional hourly charges may apply. Unless otherwise stated in writing, overtime may be charged at $75 per additional hour.

Early setup may be available for an additional fee, subject to availability and written approval by Backyard Starz.

7. Site Preparation

You are responsible for ensuring that the setup area is ready before the scheduled delivery or setup time.

The setup area must be:

  • Clear of personal items, furniture, toys, debris, pet waste, and other obstructions;
  • Reasonably flat, clean, dry, and accessible;
  • Free of sharp objects, rocks, glass, rough surfaces, mud, standing water, fire ants, and other hazards;
  • Safe for the equipment, Backyard Starz personnel, guests, and attendees.

You are also responsible for clearing personal items from tables, chairs, and the setup area before the scheduled takedown time.

If Backyard Starz is delayed or required to perform additional labor because the site is not prepared, you may be charged an additional $50 per hour or other reasonable labor/delay fees.

Backyard Starz does not warrant that the ground, surface, or area selected by you is fit or proper for setup or use of the equipment.

8. Non-Grass Surfaces and Weights

Some equipment may require anchoring or weighted support, especially on non-grass surfaces such as turf, concrete, pavement, patios, driveways, decks, or other hard surfaces.

Unless included in your specific package, weighted items may not be included.

For certain non-grass setups, you may be responsible for providing four weighted items, each at least 50 pounds, or renting appropriate weighted items from Backyard Starz for an additional charge.

Backyard Starz may refuse setup or require an alternate setup location if the surface or anchoring method is unsafe or unsuitable.

9. Electrical Requirements

You are responsible for providing safe and functioning electrical power for the equipment.

Unless otherwise agreed in writing:

  1. The equipment requires one electrical outlet within 50 feet of the screen location.
  2. The outlet should be 115 volts with 20-amp capacity.
  3. The equipment should be the only equipment operating on that electrical circuit.
  4. Backyard Starz may provide electrical cords up to 50 feet.
  5. For distances greater than 50 feet, you may be required to provide a 12-gauge extension cord up to 100 feet.
  6. Backyard Starz will not set up equipment more than 200 feet from a power source.
  7. Backyard Starz does not provide a generator.
  8. If you provide a generator, Backyard Starz is not responsible if the generator does not power the equipment properly.

You are responsible for power interruptions, tripped breakers, faulty outlets, inadequate circuits, generator issues, or unsafe electrical conditions caused by the event location or customer-provided equipment.

Please turn off all sprinklers before and during the event to protect guests and equipment.

10. Equipment and Media

Backyard Starz provides only the equipment stated in your package, booking confirmation, invoice, or written agreement.

Unless expressly agreed in writing, Backyard Starz does not provide:

  • Movies;
  • DVDs;
  • Streaming accounts;
  • Video game consoles;
  • Laptops;
  • Cable boxes;
  • Internet service;
  • Public performance licenses;
  • Copyright licenses;
  • Venue permits;
  • HOA approvals;
  • Park permits.

You are solely responsible for providing and selecting any movie, video, game, streaming account, DVD, laptop, or other media source used at your event.

You are solely responsible for ensuring that any content shown at your event is appropriate for the audience and used in compliance with applicable copyright, licensing, public performance, venue, HOA, school, municipal, or other rules.

For the best viewing experience, Backyard Starz recommends using a DVD or another directly compatible media source when possible. Streaming quality may depend on your internet connection, device, account, app, cables, and other factors outside Backyard Starz’s control.

11. Weather and Outdoor Conditions

Outdoor movie rentals are subject to weather and outdoor conditions.

Backyard Starz does not set up in active rain. If you have an alternative covered space, setup may be possible if Backyard Starz determines the space is safe and suitable.

Backyard Starz reserves the right to cancel, delay, modify, or reschedule your event in the case of rain, high winds, lightning, thunderstorms, wet ground, unsafe electrical conditions, or any other weather or site condition that Backyard Starz determines may be hazardous to customers, guests, personnel, property, or equipment.

Temporary structures and inflatable equipment may become unsafe during severe weather, storms, heavy rain, high winds, or other adverse conditions. You and your guests should stop use and evacuate the equipment area during unsafe conditions.

Weather-related rescheduling, cancellation, and refund terms are governed by Backyard Starz’s separate Weather Policy and Cancellation & Rescheduling Policy.

12. Fire, Smoking, and Hazardous Materials

You agree not to allow cooking, fire, smoking, grills, fire pits, candles, fireworks, heaters, open flames, or combustible materials under or within 10 feet of the inflatable screen, inflatable chairs, or related equipment.

You are responsible for damage, injury, or loss caused by fire, smoke, heat, burns, fireworks, grills, cooking, smoking, combustible materials, or related hazards.

13. Equipment Use Rules

You agree to use all equipment safely and only as intended.

You and your guests may not:

  1. Jump on inflatable seating.
  2. Stand on, climb on, wrestle on, dive onto, drag, stack, puncture, or misuse inflatable chairs.
  3. Operate inflatable units on rough surfaces such as rocks, brick, glass, jagged objects, or sharp surfaces.
  4. Use equipment during high winds, gusty winds, thunderstorms, lightning, rain, or unsafe conditions.
  5. Repeatedly plug and unplug motors, pumps, or electrical equipment in a way that may cause damage.
  6. Move, alter, relocate, or disassemble equipment after setup unless Backyard Starz gives permission or instructions.
  7. Allow children to climb, pull, push, hang from, or roughhouse around the screen, stands, speakers, cords, tables, projector, or other equipment.

You are responsible for any damage, injury, or loss caused by failure to follow these rules.

14. DIY / Drop-Off Package Rules

For DIY or drop-off rentals, you are responsible for setup, operation, takedown, repacking, storage, protection, and making all equipment available for pickup or return.

All equipment must be stored in a protective area and kept out of the elements.

If equipment is not ready for pickup and Backyard Starz personnel must package, gather, organize, or repack the equipment, a $75 fee may apply.

Additional fees may apply if equipment is wet, dirty, damaged, missing, improperly packed, inaccessible, or not ready at the scheduled pickup time.

15. Damage, Loss, Theft, and Cleaning

You are responsible for all repair costs, replacement costs, loss, theft, damage, destruction, or excessive cleaning involving rental equipment while it is out of Backyard Starz’s possession or otherwise under your control, except for ordinary wear and tear.

This responsibility applies regardless of cause, including but not limited to misuse, guest conduct, weather exposure, acts of God, theft, vandalism, fire, water, pets, stains, mildew, wax, or similar events.

Equipment will be inspected after pickup or return. Some damage may not be immediately visible at the event site.

Damage may include, but is not limited to:

  • Punctures, tears, stains, mildew, wax, permanent stains, food or drink residue, water damage, sprinkler exposure, pet damage, electrical damage, missing parts, damaged cords, damaged screens, damaged projectors, damaged speakers, damaged inflatable items, or equipment returned dirty, wet, improperly packed, or incomplete.

If any product is damaged, Backyard Starz may keep your deposit. If multiple inflatable items are damaged, you may be charged an administrative and overhead fee of $70 per damaged item, in addition to the cost to repair or replace the damaged items.

Accrued rental charges, deposits, or other amounts paid may not be applied against the purchase, repair, or replacement cost of damaged or lost equipment unless Backyard Starz agrees otherwise in writing.

You agree to pay all reasonable repair, replacement, cleaning, administrative, labor, shipping, collection, and related costs.

16. Collection Costs and Repossession

You agree to pay all reasonable costs, expenses, and attorney’s fees incurred by Backyard Starz in any action or effort to recover rented items, collect unpaid rent, collect damage fees, collect replacement charges, or enforce these Terms.

Backyard Starz reserves the right to retrieve its equipment if payment is not made, equipment is not returned, equipment is at risk, or these Terms are violated.

17. Insurance

Backyard Starz is not responsible for confirming that your insurance coverage is adequate to cover your event, guests, property, or potential liability.

Backyard Starz does not insure you, your guests, your property, your event, your venue, or any claims against you.

We recommend that you check with your own insurance carrier, homeowner’s insurer, renter’s insurer, venue, HOA, or policy provider regarding your coverage.

18. Cancellations and Rescheduling

Cancellations and rescheduling are governed by Backyard Starz’s separate Cancellation & Rescheduling Policy and Weather Policy.

Unless otherwise stated in writing, cancellations made 21 business days or more before the event may be eligible for a full refund of the deposit. Cancellations made less than 21 business days before the event may result in loss of the deposit.

Weather-related cancellations or rescheduling may be handled differently, as described in the Weather Policy.

19. Right to Refuse or Stop Service

Backyard Starz may refuse, delay, stop, cancel, modify, or reschedule service if we determine that:

  1. The event location is unsafe, inaccessible, or unsuitable;
  2. Weather creates a safety or equipment risk;
  3. The setup area is not prepared;
  4. Electrical conditions are unsafe or inadequate;
  5. Required access, permits, approvals, or permissions are unavailable;
  6. Guests are misusing equipment;
  7. Customer or guest conduct is unsafe, aggressive, intoxicated, threatening, or inappropriate;
  8. Required payment has not been made;
  9. Continuing service would create an unreasonable risk of injury, property damage, equipment damage, or legal violation.

20. Waiver and Liability Release

Use of Backyard Starz equipment and services is subject to the Backyard Starz Waiver & Liability Release, which is incorporated into these Terms.

By booking, submitting payment, signing a booking agreement, checking an acceptance box, accepting delivery, allowing setup, taking possession of equipment, or using Backyard Starz equipment or services, you agree to the Waiver & Liability Release.

21. Disclaimer of Warranties

To the maximum extent permitted by law, Backyard Starz disclaims all warranties, express or implied, regarding all products, equipment, services, or anything else provided by Backyard Starz, including but not limited to implied warranties of merchantability or fitness for a particular purpose.

22. Limitation of Liability

To the maximum extent permitted by law, Backyard Starz’s total liability to Customer for any claim arising out of or related to any rental, product, equipment, or service shall not exceed the amount paid by Customer for the specific rental giving rise to the claim.

To the maximum extent permitted by law, Backyard Starz is not liable for property damage, personal injury, loss of use, event interruption, loss of enjoyment, lost profits, lost data, business interruption, consequential damages, punitive damages, special damages, or indirect damages, however caused, whether based on warranty, contract, tort, negligence, strict liability, or any other theory.

Backyard Starz is not liable for failure or delay in performance caused by events outside its control, including but not limited to acts of God, weather, power outages, traffic, road closures, illness, emergencies, equipment failure, labor shortages, government restrictions, or unsafe site conditions.

23. Indemnification

To the maximum extent permitted by law, you agree to release, indemnify, defend, and hold harmless Backyard Starz, LLC, including its owners, members, managers, employees, contractors, representatives, agents, affiliates, successors, and assigns, from and against any and all claims, damages, liabilities, losses, costs, expenses, and attorney’s fees arising out of or related to:

  1. Your event;
  2. Your breach of these Terms or any Backyard Starz policy;
  3. Your use, misuse, supervision, or handling of rental equipment;
  4. Any act or omission by you, your family, guests, invitees, vendors, or anyone present at the event location;
  5. Injury to or death of any person;
  6. Damage to or destruction of any property;
  7. Unsafe site conditions, inadequate electrical conditions, weather exposure, guest conduct, permit issues, HOA or venue rule violations, noise complaints, alcohol-related incidents, or movie licensing/public performance issues;
  8. Damage to, loss of, theft of, or excessive cleaning required for Backyard Starz equipment.

24. Website Use

You may use the Backyard Starz website only for lawful purposes, including learning about our services, submitting inquiries, requesting bookings, and communicating with us.

You may not misuse the website, attempt to interfere with its operation, submit false information, copy website content for commercial use, or use the website in a way that violates applicable law or the rights of Backyard Starz or others.

All website content, including text, images, graphics, logos, package descriptions, layouts, and other materials, is owned by or licensed to Backyard Starz and may not be copied, reproduced, or used without permission, except as permitted by law.

25. Incorporated Policies

These Terms incorporate and should be read together with all applicable Backyard Starz policies, including:

  • Waiver & Liability Release;
  • Payment Policy;
  • Cancellation & Rescheduling Policy;
  • Weather Policy;
  • Setup, Delivery & Pickup Policy;
  • DIY Drop-Off / Self-Setup Policy;
  • Damage, Cleaning & Missing Equipment Policy;
  • Equipment Safety Rules;
  • Electrical, Power & Generator Policy;
  • Movie, Media & Copyright Policy;
  • Noise, Time Restriction & Neighbor Policy;
  • Alcohol & Guest Conduct Policy;
  • Photography & Social Media Policy;
  • Accessibility / Accommodation Policy;
  • Privacy Policy.

If there is a conflict between these Terms and a signed booking agreement, invoice, or event-specific written agreement, the event-specific written agreement will control for that event, unless prohibited by law.

26. Governing Law

These Terms are governed by the laws of the State of Texas.

Any dispute arising out of or related to these Terms, a Backyard Starz rental, or Backyard Starz services shall be handled in a court of competent jurisdiction in Texas, unless otherwise required by law.

27. Changes to These Terms

Backyard Starz may update these Terms from time to time. The version posted on our website at the time of booking will generally apply to your rental unless otherwise stated in your signed booking agreement or written confirmation.

28. Customer Acknowledgment

By booking a rental, submitting payment, signing a booking agreement, checking an acceptance box, accepting delivery, allowing setup, taking possession of equipment, or using Backyard Starz equipment or services, you acknowledge that you have read, understand, and agree to these Terms.
